SUPREME COURT APPEAL.
An appeal from the decision of Mr. E. C. Cutten, S.M., in an application under the Destitute Persons Act, by Alice F. Topp (Mr. Graham), against William A. Topp (Mr. Richmond, instructed by Mr. C. C. Chalmers), was heard before Mr. Justice Sim in the Supreme Court yesterday. The magistrate made an order in plaintiff's favour for maintenance at the rate of £2 10s a week. The grounds of the appeal were that there was no evidence of persistant cruelty, such us was found by Mr. Cutten, and that the weight of the evidence was against the finding of the Lower Court. Judgment was reserved.
