PLAINTIFF ABANDONS CLAIM,
MAXGOXUI HOSPITAL CASE.
A Supreme Court action to recover damages for an alleged wrongful dismissal :arae to an abrupt termination yesterday, vhen Mr. Ostler, counsel for the- plaintiff, innouuced that the latter had, on his ] 'ounfel'ts advice, abandoned his claim, it laving been agreed that each side should i >ay its own costs. The action, which was :ommcnccd on Tuesday before Mr. Justice I hooper and a jury of 12, was brought by I Percy W. Menties, medical practitioner, | igainst the Bay of Islands Hospital and Charitable Aid Board (Mr. Reed, K.C., I »nd Mr. Alexander), to recover the sum of | £201 as general damages and £300 as i special damages for alleged wrongful dis-, missal from the position of medial super-1 intendent of the public hospital at Mango* I nui. The plaintiff had been dismissed on ] three months' notice, the notification con-, eluding will) the paragraph : " This action has not been taken because of any want of skill upon your part as medical superintendent at the hospital." After confirming the statement of counsel for plaintiff, Mr. Reed read a statement in ' which certain allegations by the plaintiff | were refuted. Ho said the defendant! board did not think it worth while to go on since the plaintiff had abandoned his j claim, and as the continuation of the hearing would mean considerable (fxpenfe and ! inconvenience to a large number of wit-1 nesses, who had been brought to Auckland. '
