CLAIM FOR BOARD.
JUDGMENT FOR DEFENDANT. 1 Judgment in respect of a claim by Frances M. Byrne (Mr. Graham), 15, Ireland Street, Ponsonby, against James Murray (Mr. Singer), farmer, of Auckland, for the recovery of £13 10s, of which £10 108 was allegedly due for board, and £3 for a blanket and sideboard allegedly sold by auction, was given by Mr. J, E. Wilson, S.M., at the Magistrate's Court yesterday.
At tho hearing it was contended by Mr. Singer that there had been no expectation of payment, and Mr. Graham contended that if there had been no expressed con-1 tract tluro was an implied obligation to pay for services rendered. fho Magistrate said no evidence had been adduced to show that there was an agreement to pay, and in view of testimony tendered on behalf of the plaintiff he did nob think ho would be justified in making an order for payment based on equity in good conscience. On the count in respect of chattels the plaintiff would bo non-suited, and judgment would be entered for the defendant on the claim for board.
