CLAIM FOR DAMAGES.

ALLEGED FAULTY WORKMANSHIP. | « l G Alleged faulty workmanship in connect lion with the construction of a ceiling " was the basis of a claim heard before Mr. '' Justice Cooper, at the Supreme Court ? yesterday,*' when Tony Anthony Petrie, a merchants, of Customs Street (Mr. Dennis- 1 ton), claimed £500 damages from the s Auckland Fibrous Plaster Company, Ltd. , * (Mr. Glaister). |{ It was stated that the defendant com- ] pany in May, 1917, offered to supply and a fix ornamental ceilings and cornices in r plaintiffs house at Remuera, at a cost of ] £60. It was al'.oged'that the work was ] carried out in a faulty manner, with the £ result that part of the ceiling fell, damag- t ing the plaintiff's property. The plaintiff ] therefore claimed £112 special damages 1 and £388 genoral damages. _ | The defence was a general denial of the i allegations, and it was stated that the i defendants did all the work well, with i the best of materials, and that if any por- ! tion of the ceiling fell, it was due, not to tho defendants, but to faults in tho > house, which were outside the defendants' control. It was also denied that the falling of the ceilings did any real damage to plaintiff's property. ! The case for the plaintiff was completed and Mr. Glaister addressed ( the jury, ; afterwards calling his first witness. The evidence being taken is mainly of an expert nature. At the request of counsel tho Judgo ordered a view of the premises, which the jury will visit to-day. The proceedings were adjourned until this morning. — nmmmmmmtmmm —■
