GAMING ACT CHARGES.
JUDGE QUASHES CONVICTIONS.
Reserved judgment in respect to motions for an order quashing the convictions of two Chinamen, named Harry Wong and Wong Timjjori charges of having assisted in conducting a common;;gaming house, j was delivered by. Mr. Justice Cooper j yesterday. Each of the Chinamen was ,' arrested on September 29, at the premises i of Wong Ling, l a Wakefield Street, and each was»convicted and fined £100. The! groundi; upon which the motions to duashj the convictions were made were that the' convictions did not disclose a date when the alleged offence was said to have been' committed, and were therefore, uncertain and vague, and further, that the convictions were void or defective in that no default was fixed in the event of the nonpayment of the fines and costs, as provided by the Gaming Act, 1908. His Honor held that •': the convictions were technically defective; and must to quashed. He. said this action would not : prevent a prosecution of «ither of the parties for an alleged offence of having assisted, in conducting the business of a common gaming house on a pai icular date within the period of sit months. Mr. Dickson appeared for the appellants, and the Hon. J. A. Tole, K. 0., for the Crown.
