INTERPRETATION OF WILL.

ARGUMENT IN SUPREME,. COURT. A case involving the interpretation of a deed of settlement was argued before Mr. Justice Hosking at the Supreme Court yesterday. The facts were that on October 23, 1878, Mrs. Mary Ann Peach conveyed to John Ellyett and James M. Lennox, certain real and personal property, to be held in trust. Lennox died in 1917, and Albevt Victor Burcher was appointed trustee in his stead. The deed of settlement provided that Mrs. Peach sihould enjoy the income from the trust property during her lifetime, and that after her death the property should ■ be divided, one half to go to her married (laughter, Mary Agnes, if she should attain 21. years of age, and the remaining half to Mrs. Peach other children in equal fib.ares. In the event of the death of Mary Agnes, the whole trust property was to be divided equally among the remaining children. Mary Agnes died after iihe reached 21 years, and during the lifetime of Mrs. Peach. The question for the Court to determine waj whether the halfshare bequeathed to Mary Agnes should revert to lie.' children, or whether it should be awarded to the remaining children of Mrs. Peach.. Mr. McConnell appeared for the trustees of the deed of settlement, Mr. Patterson, for the representatives of Mrs. Peach's daughter, Mary Agnes, and Mr. Banna for the other children' of Mrs. l?each. After hearing argument His Honor reserved his decision.
