RATES ON GAS MAINS.

LEGAL TEST AS TO LIABILITY.

Tjre matter of concentrated action by local bodies in forcing the Auckland Gas Company to continue to pay rates .on mains, which this year the company has refused to do, was discussed at a meeting of the Newmarket Borough Council held last evening.

The town clerk reported that the Gas Company had returned the demand claiming rates on tho mains within tho borough. Under instructions from the council he had written to the Municipal Association, Wellington, and Mr. Martin, the secretary had advised him that the Takapuna Borough Council was making a test case, in which decision had not yet been given. The Takapuna Council had again written to Mr. Martin, asking that a levy he made on all local bodies belonging to the Municipal Association, to fight the ca3o. The clerk urged that as large amounts of rates were outstanding within the suburbs of Auckland, most of which had incurred the 10 per cent, penalty, the Auckland City Council, the Mount Eden, Mount Albert, and Newmarket Borough Council* together with other adjacent town and road board?, bo urged to take- joint action to have the case decided. The council agreed to act on the clerk's suggestion.
