ABROGATED BY THE WAR.
ZINC CORPORATION CASE. DISSOLUTION OF CONTRACT. London, September 8. Judgment in the case brought by the Zinc Corporation has been delivered in the King's Bench Division. The Judge decided that the contract was dissolved on August 4, 1914.
FREEING INDUSTRY.
EFFECT OF JUDGMENT. Melbourne, September 9. The Hon. Mr. Hughes, commenting on the judgment in the case of the Zinc Corporation, said that although he was unable to say how far it was capable of general application to enemy contracts even in its most limited form, it would help materially in freeing the industry in Australia from the grip of the enemy. In the King's Bench Division of the High Court of Justice, at the end of last month, the Zinc Corporation asked for a declaration that a contract, dated April, 1914, to sell spelter to Hirsch and Son, of Halberstadt, Germany, was abrogated by the war. The defendants contended that the contract was merely suspended, not abrogated, by the war.
