APPEAL COURT DECISION.
[BY TtLt-.RJk.rH.— PRE-S VsSOCI AIIOK-J Wellington, Tuesday. Thf. Court of Appeal delivered resened decision this morning in the ca-«« of the Public Trustee v. the Uutt River Board. The Court dismissed the appeal, affirming the decision of Mr. Justice Edwards that the Public Trustee is liable to pay rates upon lands purchased by him out of moneys belonging to the common fund of the. Public Trust Office. The ground of the decision is that the common fund is not money belonging to the Crown, or in which the* Crown is beneficially interested, and that, therefore, there b no exemption from rating. Costs were allowed to tb« Butt River Board.
