ARBITRATION COURT RULES.
ONUS OF PROOF.

..rixixCTOX. Thursday. The Gazette to-night contains the fallowing rules for the guidance of clerks of awards and parties to industrial disputes, as made by the Court of Arbitration by virtue of section 104 of the Industrial Conciliation and Arbitration Act, 1908:—
1. No person, firm, or company shall be cited or named as a party to an industrial dispute unless the occupation and' full postal address of such person, firm or company be also given, and if the party cited or named be an individual his cor-' rect initial or initials shall also he given. 2. If any person, firm, or companv duh cited shall appear before the Court at the hearing of a dispute, either in person or by representative duly appointed, and shall make objection to being cited or named as a party to the dispute on the grounds that he or it is not engaged in the industry, the onus shall be upon the union of proving that such person, firm, or company is so engaged. 3. If any person, firm, or company dulr cited shall appear before the Court at the hearing of the dispute and shall make objection under the precedinc rule, and the Court shall uphold such objection and make an order striking out from the hit, of parties the name of such person, firm or company, then the Court may order Uiat the union pay the expenses—according to the Magistrate's Court scale— the attendance of witnesses, together with the travelling expenses, if any. incurred by such person or representative in so appearing. m 4. The foregoing rules, numbered 1 to 3, inclusive, shall apply mutatis mutandis to any application to add parties to an industrial dispute or award.
