COUNCIL V. DEPARTMENT.

New Plymouth, Wednesday. An action, in which the New Plymouth Boroncli Council claims £1769 as compensation from the Public Works Department, is beiiif heard before Mr. Justice [tasking. The claim if in respect to gravel taken by the Department from a pit on the property of tho council. Evidence was given that tho Department had taken gravel for nine years. Then at the request of the ccaJKi! it took the land by proclamation
The Department claims that by requesting that the land be taken under proclamation tho council forfeited tho right to compensation.
