CLAIM FOR ROYALTY.
AN IMPORTANT JUDGMENT. [BY TELEGRAPH. —PRESS ASSOCIATION.] New Plymouth, Tuesday. A judgment of importance to West Coast lessees was delivered in the Ma Citrate's Court in the case of the Public Trustee v. Chas. Andrews, a claim for £32 13s 6d royalty paid to the defendant for stone taken from land leased from the Public Trustee.
The magistrate held that the stone was reserved to the trustee as part of the soil, and that the royalty of 3d per yard was received on behalf of the trustee. He assessed the value of the stone in the river at one-third, and surface damages (on account of which defendant claimed the royalty) at two-thirds, and therefore gave judgment for the Public Trustee for onethird of the amount claimed, £10 17s lOd. and costs £5 2s. An appeal may be lodged.
