Berlin, March 5. The Public Prosecutor has appealed against the acquittal of Count Mielzynski on a charge of murdering his wife and nephew .at the Castle of Dokowymokre, near Graetz, in. German Poland, on December 19.'

Count Mielzynski himself- reported the occurrence to the public prOßeentor, : ". staining. that bearing a noise in the night, he concluded that burglars were breaking into the'.castle. Going downstairs armed with a gun he encountered hie wife and her nephew, Count Mianczynski, in the lady's bedroom, and shot them both dead. The marriage which, came to such a terrible end began under tragic omens. Eighteen years ago . Count Mielzynski, who was then a suitor for- - the hand .of the beautiful daughter of Count Potocki, shot himself in the breast because Count Potocki opposed their marriage.- • He • inflicted a wound, from the effects of which he never entirely recovered. Moved .by such ardour, Count Potocki yielded, -and ijhe couple were married. A few years -ago the count confided to his friends that hs was anxious regarding his wife. He sold his estate and went to live at Dresden. Later the countess left her husband ajid went to live with her brother. Count Potocki. A year ago, on the death of tier brother, the countess succeeded to the estate of Dokowymokre and became mistress of a large fortune. The family brought about a reconciliation, and" the count went to live with his wife at Dokowymokre. But the renewed union was soon clouded. The count began his political career as a fierce opponent of Prussian rule in Poland. His obstinacy, .earned for him the nickname -of '.'the Red Count " -
