The hearing of the charge against a young man named Charles Armstrong (Mr. Hall Skolton), that he assaulted Lena Fenner, causing her actual bodily harm, was opened at the Auckland Hospital yesterday, where the complainant is still a patient. Maguire, medii cal superintendent, was that Lena Fenner J was admitted to the institution on Novemj ber 19, 1913, suffering from a serious I fracture' of the ankie and bruises round j the eye and ear. He considered that the I injuries to the ankle were caused by direct | violence, such as a blow or a kick, rather ! than by an accidental fall. The patient at I tLe time of her admission was intoxicated.

Lena Fenner said that ou the evening oi' November 19, she met a woman named Tot Casey, with whom the accused was living. This woman asked her to go with her into the house to assist her to get her belongings, as she intended leaving the accused. Witness went into the house and knocked at the bedroom door, but not getting a reply, she went in and found the accused lying on the bed. She told him to wake up. He sprang up in a dazed manner, and without saying anything, punched her on the face and kicked her on the ankle. He then went out. She did not think that the accused knew who it was. He was not sober.

The case was here adjourned. It will be continued at the Police Court on March 11.
