COUNCILLOR AS DEFENDANT

CHARGED WITH LOITERING.

Loiter on the footpath, so as to cause' an obstruction, formed the subject of a charge against Adani Nixon and Hugh McMahon, before Mr. F. V. Frazer, S.M., at the Police Court yesterday. Evidence was given by Constable Dwyer to the effect that on a Sunday evening some weeks ago the accused were standing in the middle of the footpath at the corner of Queen and Quay Streets. He requested them to move, and they then went to the sidb of the footpath, still, however, causing an obstruction. Witness accordingly again requested them to move, and to this they replied by standing in the road with their feet against the kerb. A different version of the affair was given by the defendants, who were repre- J sented by Mr. A. E. Skelton. Nixon, who! is a member of the Devonport Borough i Council, stated that the first warning they j received was when they were standing on j the edge of the path. They afterwards I moved away from the footpath, and it was about that time that their names were taken. Several other witnesses gave evidence for the defence, the case then being adjourned till this afternoon. '
