CHARGE AGAINST MOTORMAN.

ALLEGED NEGLIGENT DRIVING.

As the result of a collision between a tramcar and a scoria-laden dray at Eden Terrace, John Munro, the driver of the car in question, was charged at the Police Court yesterday, before Mr. E. C. Cuttcn, S.M., with negligent driving.

The defendant was represented by Mr. j Skelton, Mr- W. D. . Lysaght- watching j proceedings on behalf of the Tramways Company. ..-. . ,».■"... ; -.-. : --, : : \-\ 111 outlining the case against 'the defendant, Sub-Inspector Hendrey stated that on the day of the collision, a man named Claude Marmont was driving a dray full of scoria up the Eden Terrace rise. Another vehicle was in front of him, and he consequently had to pull on to "the tram rails. Defendant'a car' was approaching,; and collided with the dray, , there being no reason why defendant could not Jiave averted the collision by _ applying hit* brakes in time.

Andrew Young Ross deposed that at the time of the collision- the tramcar was "trayelling at'only a moderate speed. He did not hear the motorman sound'the gong. ' ■ • Mr. Skelton submitted that the defendant had handled his'.car with cares and skill, and that the collision was wholly due to the action of the driver of the dray, .in pulling his vehicle suddenly :on to' the tram rails in "order ,to avoid the other vehicle in front of him. ■ .',''■', After hearing the evidence of two other witnesses, who were passengers 'in the tramcar at the time of the collision.
