McINTYRE FOUND NOT GUILTY.

RESULT OF THIRD TRIAL.

At the Supreme Court Mr. Justice Chapman on the Bench, John Alexander Mclntyre, who was defended by Dr. Bamford was tried for tho third time on a charge of having on November 1, 1911, together with one Joseph Ehrman, stolen a caso of cigarette tobacco, the property of W. and (1. Winstone, Limited, from the Customs examination shed on Queen-street Wharf. It will bo remembered that this was one of tin charges in regard to which there was quite a series of prosecutions. Mclntyre was tried twice on the present charge, and on each occasion the jury failed to agree. Yesterday the evidence adduced for the prosecution was practically the- same as that given at the previous trial. One witness, a man named Robert Alexander Brown, was ill, and could not bo present, and Detective Powell is on duty in Gisbonne. Consequently the evidence given by them at the last trial was read from the depositions. Dr. Bamford did not call any witnesses, but contented himself with addressing the jury at some length. The jury deliberated for two hours and a-half, and returned to Court with a verdict of "notguilty," and tho accused was discharged. THEFT BY A GARTER. COMMUTED FOR SENTENCE. A young man, Tod McCully, was charged before Mr. E. 0. Cut ten, S.M., in the Police Court yesterday, with stealing from tho Hobson-btrect Wharf throe tins of meat, and four tins of condensed milk. Evidence was given to show that the accused, who was a driver, took a load of tinned meat to tho wharf and placed it besido somo cases of condensed milk. Subsequently the cases were found to be broken open, and "some of the stolen goods were discovered in accused's waggon, the remainder being found at his house.

The accused, who pleaded guilty, was committed to i-ho Supreme Court for sentence.
