A SALE OF GRATES. _ .'•',: •? Mr. Kettle gave judgment in the case in which Baker and Co., Ltd. sought 1 to recover ;from, F. ,R. Alderton, of■ .'Whangarei. the sum of £4 14s, being 'amount of goods . sold ? and delivered. Mr. Southey Baker appeared for plaintiffs, and Mr. Gould for defendant. Plaintiff's traveller had received an order from defendant • for - a number; of grates. Plaintiffs had supplied part of ; the order, but as the grates ; were broken on arrival de- [V.: fendant refused to take - delivery. ■- His -■■■■:;■:■■ Worship, in giving judgment, said' the offer being' an entire one, it 'must be accepted in its entirety, and the defendant (the buyer) was not ; bound -to accept delivery by instalments. . Upon these grounds .apart from others, judgment would be for defendant. Leave to appeal was granted to Mr. Southey Baker.
