CASE AGAINST THE COUNCIL.

At the Supreme Court to-day His Honor Judge Edwards heard a motion for a writ of mandamus, brought by Matthew and Barbara Eraser Henry, settlers, of Waitoa, against the Piako County Council, to command the latter body to open up and dean certain portions of the watercourses adjacent to their property, which, it was alleged., were calculated to impede the free flow of water, and so relieve their property of certain flood waters caused by the said drains being in a state of disrepair. Dr. Bamford (Auckland) represented the plaintiffs, and Mr. Swarbrick (Hamilton), instructed by Mr. Gilchrist (To Aroha), defended. The evidence, which was of a very voluminous nature, occupied the attention of the Court the whole day. Judgment was reserved.
