A DYING WOMAN'S GIFT

ON A VOYAGE TO NEW ZEALAND.

Justice Grantham was called upon a tew days ago, in the Kind's Bench Division to decide a . case whether jewels given to * woman on & voyage to New Zealand by a dying friend could be held legally to belonc to her. \ 6 Mr. George Isaacs Mildenstein, an emigration agent at Liverpool, as executor under the will of his step-sister, Miss Phoebe Mildonstein, sued a friend of hers, Mrs. Marion Freeman Nainby Luxmore, a wealthy widow living at -Putney, lor the return of article! of jewellery valued at £55. The widow was a distant relation and an intimate friend ?of Miss Mildenstein. In November, . 1907, the latter joined Mrs. Nainby Luwnore's part v, which was going to Now Zealand. They left "England by the sis. Mongolia. On the way Miss Mildenstein was stricken with ; typhoid fever,: and believing herself to be, dving she gave the jewellery to the widow 'for her many kindnesses. The lady had to be put ashore 'at Melbourne without completing the j journey, and ; died in hospital. Airs. juzxmore' sent f the lady's trunks to the plaintiff at Liverpool, and he now sought to recover the jewellery. ; Mr. ;■ Justice Grantham - thought v there was no evidence to raise susnicion as to the accuracy of Mrs. Luxmore'« statement that the jewellery" was given her by the friend, who believed she was about to die. He therefore gave judgment for her, with costs.
