Wellington, Saturday. ; An interim injunction granted on September 24 ;. ','hristopher Joseph Lyne, a school terti'ltrtr. by Judge Chapman, restraining the- Wellington Education Board from removing him from his position in the Lower Hutt District High School, and from withholding his salary, was dissolved to-day by Judge Chapman, who had reserved his judgment at tho Supreme Court hearing. Plaintiff, according to his statement, absented himself from duty a day and a-half owing to illness. Suspension by the school committee followed, and the committee's action was confirmed by the Education Board. ' Subsequently plaintiff was allowed to resume duty till June 29, when the Board, after consultation with the new school committee, wrote him purporting to terminate his engagement as from September 30. Plaintiff claimed that such action was ultra vires, as no charges were formulated against him, he was not allowed to make a defence, and the Board had not properly consulted the school committee. The Court to-day hold that the conference was properly constituted and carried out, and that there was nothing to show that the new committee was asked to take evidence as to alleged, falsifying of evidence among the records that tho old committee had taken previously. ■;:;■■:/;.
