MOTOR CAR TROUBLES.
A PECULIAR CASE.
At the Police, Court yesterday, before Mr. Kettle, S.M., Walter Scott Brockway,
medical practitioner, appeared to answer an information charging him with assaulting S. H. Howie, who " prayed that de-
fendant bo bound over to keep the peace."
Mr. McVeagh appeared for the informant, j and Mr. Hackett for the defendant, the ! latter pleading guilty. Defendant stated that lie had purchased a motor car from Mr. Howie, who undertook to keep it 'in order. The car was running badly, and finding that his own accumulator had been replaced by another
of inferior quality, defendant went to informant's place of business in Karangahape Road, and asked him why he had taken his accumulator. Mr. Howie replied, "Because you stole mine." With that defendant struck him. In croee-examination, defendant said he had not assaulted the informant before. The informant was also placed in the witness box, and (stated that a few seconds after entering the shop Dr. Brockway used an objectionable epithet, and struck witness in the face, also continuing to punch him about the body. Witne.se called for the police to be brought in. He had to consult a doctor, having received a black eve and being badly bruised. The accumulator which he placed on defendant's car was his own, while the one replaced belonged to another customer. Witnef* did not give the defendant provocation or insinuate that he had stolen an accumulator. Defendant was fined £2 (£1 to go to the informant), and costs £2.
