Leigh, sheep farmer, of Lower Hutt, according to the statement of claim, instructed William T. Strand, timber merchant, of Lower Hutt, to purchase for him certain lands, comprising altogether 22 acres I rood 5 perches, at a price not to exceed £200 per acre, and plaintiff agreed to pay defendant for his services 25 per cent, of the profit plaintiff might make on a resale. The purchase was arranged at £200 per acre, and plaintiff paid £4624 for the properties, and also paid defendant £650 for his services, Subsequently plaintiff discovered that defendant hud got the properties fnuii the vendors for £2960, and. it was alleged, appropriated the balance of £1664 to his own use. He therefore claimed the £1664 and the £630 paid to defendant for In* •service?, a, total of £2294. The defence was that the defendant had bought, the properties tor himself, and resold them to the plaintiff, and that the plaintiff understood this. Defendant said the payment of £630 was in respect ol another transaction. A number of witnesses were examined, and the. case was not finished when the Court lose for the day.
