Henry Sirmtov Izard appeared on remand at Hi" Magistrate's Court, Mastertoil, before Mr. .lames, S.M., this morning, to answer to 11 charges of fraudulent breaches of trust, and misappropriation connected with his bankruptcy, on information laid by Mr. Chennells, deputy official assignee. Mr. I'.. J. Dolan appeared for the Grown, and Mr. ('. A. Pownall (under instructions from Mr. ('. P. Skerretl) for the accused. Mr. If C. Robinson watched the cast" on behalf of the Mahupuku estate. Mr. Polun stated thai it. had been mutually agreed between the Clown and accused's counsel that only four charges should be taken, so as to shorten he proceedings. The remaining charges would l>e formally withdrawn without prejudice. A statement handed in by the accused, making certain admissions, would considerably shorten the proceedings. The statement, was as follows: '■ I have lead the four cities of informations laid against me by you, ami marked A 11 0 and D respect I admit all the facts alleged against me in those informations, and that I have committed the offences therein."

The charges read as follows:—(A) That Henry Stratton Izard, of Oreytown,' solicitor, a bankrupt, trustee in the estate of Martha Mahupuku, mulct deed of settlement dated August 6, 1895 (1), on or about July 6, 1895, received £16.000 under order of the Supreme Court, with the direction that it should lie invested in certain securities under the Settled Land Act. 1886. the investment to be held by him according to the trusts of the deed of settlement; (2) on or about July 17. 1905, received as such trustee £12.000 from the Public Trustee, with direction that it should be invested and applied in favour of Martha Mahupuku. under the Maori Real Estate Management Act, 1888: that accused fraudulently applied £15.976 17s 6d of such money to his own use : (b) that on or about June, 1905. lie received from Henry Robert Bunny, of Ahiaruhe, sheep farmer, and lidward Bolton Bristowe, of Wellington, merchant. £1837, with the direction that it should be deposited in the Wairarapa Permanent Investment and Loan Association, at interest, pending investments being found for the same, on the mortgage of freehold security, and fraudulently applied it to his own use: (c) that on or about May 19. 1906, he received from William Henry Parker Jones, of Petone, settler. £500 to be applied in taking an assignment from self to Jones, of a mortgage debt and security from Joseph Fellingham to self, to secure the sum of £500. and fraudulently applied such money to his own use ; (d) that about February 16, 1904. he received from Thos. Conwell, of Dalefield, farmer, £500 to apply in an investment and loan on first mortgage to Mary Sexton, over 112 acres of land situated in Gladstone, and fraudulently applied such money to his own use.

The accused then pleaded guilty, and was committed to the Wellington Supreme Court for sentence.

Bail was fixed as before, accused in £2000 and two sureties of £2000 each.
