A TEST CASE.
[bt TELKQEAyn.— association.] Invehcaegixi,, Thursday. At Gore to-day Mr. Cruickshank, S.M.. s gave judgment in the case of Police v. Whittingbam, a brewer, at Gore, in the Mataura no-license district. The case was a test one to decide whether the defendant could t execute ordeirs for beer far delivery outside of the electorate. The Crown Prosecutor, Mr. F. M. McDonald, had contended that delivery to the railway, or a common carrier, at Gore, was delivery within the moaning of the Act. The magistrate differed, holding that Whittingham had control over the liquor till taken possession of by the person to whom it was consigned outside of the no-licens» district. Security for appear was fixed at £20. _■ . '
