MAN WHO SHOT HIS DAUGHTER'S BETRAYER- ACQUITTED. Naples, September 9.—The trial of Ernest delli Fraud, accused of murdering Count del Balzo, which was opened at the Assize Court here on June 23, was concluded today. The accused has been acquitted. The tragedy took place so long ago as January of last Tear.

Count Del Balzo induced Lucia delli Franci, daughter of the accused, to leave her home for his. He was brought before the magistrates and imprisoned for several days for abduction. He was released on undertalcing to marry the girl, but refused to fulfil his promise. On coming out of prison Carlo, one of the brothers of the young woman, challenged him. At the same time Ernest delli Franci tried to conciliate matters by persuading the count to make the reparation he had promised, and arranged to meet him on the evening of January 22, 1902, to discuss the affair. The two met in the Piazza Dante, mid the conversation ended by Ernest delli Franci drawing his revolver and shooting Count del Balzo, who was killed by two bullets fired at close quarters. Ernest delli Frauci said in his defence that, besides the dishonour to his daughter, Count del Balzo had grossly insulted him during their conversation by proposing to provide for the girl. On this he lost control of himself and fired the fatal shots.

When the jury announced their decision and the judge granted the acquittal, the people in Court, applauded loudly, crying, " Long live popular justice." Robert del ljalzo was a scion of & noble but decadent family. He had served in the army, and arrived at the rank of captain. He was a man of pleasure, and lost almost, all his fortune. On retiring from the army he lived with his mother, who provided for all his wants.

In the autumn of 1901. on returning from Monte Carlo, where he had sustained great losses, he was ashamed to see his'family, and therefore took lodgings in a second-class hotel not far from the square where he was afterwards killed. It is said that a gipsy had prophesied his violent end.

The delli Fraud family is much esteemed, and everyone is sorry for the misfortunes that have overwhelmed them.
