Mr. Justice Owen held that it was clear that the Court to which the* appeal should lie from the Court of Summary jurisdiction, was for the purposes of such appeal invested with Federal jurisdiction, therefore he over-ruled the attorney's objection. [The steamers Kelloe ' (501 tons) and Dunmore (277 tons) collided off Botany Heads, Sydney, on May 13. the Dunmore was badly damaged, and had to be run ashore, whilst the Kelloe sank in 15 minutes.
