POSSESSION OF A HOUSE.

[BY TELEGRAPH.—OWS CORRESPONDENT.] ! Paeeoa, Thursday. A CASE of rather an unusual nature came before Mr., Warden Bush at the Warden's Court this morning, Mr. F. Hayward having brought an. action against M. Hoft'ron, claiming £10 damages, and asking for the immediate possession of a house .at Waildno. Mr. Jackson, who appearod for complainant, stated that during the , holidays the defendant had taken possession of a houso at Waikino, and had refused to leave when requested to do so. Proceedings were then instituted, in order to compel him to leave, and though Mr. Heffron had said he would withdraw if the proceedings were withdrawn against lam, and had paid £2 to complainant's solicitor, he impudently remained in tho house, ; and was there that morning. Mr. Gooch was called to show that ho acted as agent for complainant, and had lost . a tenant who, if he could have gained possession of the house, was willing to have taken tho promises for 12 months or two;years, but owing to the attitude of defendant ho could not got -the house, so had to make other arrangements for a dwelling. His Worship said (hat Hoffron, taking possession the way he did, did not deserve consideration, and in addition to paying the £2 already handed in to complainant's counsel, judgment for £5, with costs ;£2 13s, would be entered up against defendant; -olso that latter be instructed to give up possession of tho residence forthwith.
