Mrs. Heifer- ? nan, of Caulfield, had instituted an action <fM against James Hayes, the well-known jockey, claiming £1000 for slander. Defendant pleaded in defence that if the words com- 15 plained of were used, they were while he was j suffering temporary madness caused by ex- 'b| cessive drinking. Justice Hodges ordered that this ground of defence , be, struck out of the pleadings, as it was no ;:i| defence, and was unnecessary and embarrass- jA ing.
