Joseph Bowden and Charles O'Dowd {two men employed by the City Counci. contractors to tho removal of dust) were chafed with having commuted a breach o th wty by-laws, by allowing offensive matter to be spilled on a public street. Mr. J. R. Keed appeared for the defendants, and Sub-Inspec^ tor Wilson prosecuted. .Constable Payno said the accused were driving » dust rart up Queen-street on the 25th of ast month, and it was so full that a lot of old mortar, bricks, paper, and shavings fell off on to the road. Mr. Reed said his clients intended to take every precaution against anything of the kind occurring again, but he submitted that on the present chargo there was no offence within the meaning of the by-law, as the stuff that had fallen upon tho street was not offensive" matter as indicated there. His Worship said he thought it was not offensive matter within the meaning of the by-law,-which lie considered meant offensive in the way of smell ing badly. He did not think it meant offensive to the eye.. Tho case must be dismissed, but he would point out that the men might have been prosecuted under the Police Ulfences Act, and convicted.
