Gibson, M. H. Weed, Philip M. Lilienthat, and Meyer 3 Erhman, for an accounting and for damages. g The plaintiff, C. A. Spreckels, youngesb ~ son of Claus Spreckels, claims to be the 3 owner of 990 shares of the Hawaiian Comj mercial Company, 700 of which stand in the name of Claus Spreckels, and 250 in . the name of H. L. Dodge. Mr. Spreckels has demanded that the shares be transferred in his name, but, as he alleges, the j defendant corporation, "at the instance of 9 the said defendants, Claus Spreckels, J. D. * Spreckels, and A. B. Spreckels, and purr suanl) to a fraudulent conspiracy," have refused to make the transfer. In his com- ' 7 plaint, the plaintiff also alleges that the c assets ot the company amount to 447,709 0 dollars 78 cents, while there are only 5000 .. dollars in outstanding liabilities.
