AN INEXCUSABLE OVERSIGHT.
tBY TELEORAPH.—PRESS ASSOCIATION.] Hokitika, Thursday. At the District Court, to-day, before Mr. Broad, Michael Jackson, accommodationhouse keeper, Christchurch Road, was charged with perjury. Mr. Macfarlane, Resident Magistrate, who gave evidence, produced his appointment from the Governor dated December '25. Mr. Macfarlane was appointed a magistrate in February last, but through some stupid oversight on the part of the Justice Department, no warrant of his appointment was made or signed by the Governor. It appeared that the Gazette notice was neglected, consequently all Mr. Macfarlane's judicial acts from February Ist to December 25th are bad, and it will be necessary to ask Parliament to dhss a Validation Act, if that, will remove the difficulty. In Jackson's case, Mr. Broad directed the jury to return a verdict, of " Not guilty," and the case was not gone into. Jackson's two sons are charged with assaulting Colgan, the informant in the perjury case. The hearing lasted up to ten to-night. The case was adjourned till to-morrow.
