Wellington, Friday. Cit ky, the New Caledonian escapee, was informed to-day shortly after the rule absolute was granted, that he was not to be extradited. He was much affected, and burst into tears. Cury states that he will remain in this colony, and by his future life show that he is not undeserving of the privileges of a free man. 1 understand he will return to Auckland. Gasparini will be removed from the Wellington Gaol to-morrow, and handed over to a detective, who will accompany him in the Wakatipu to Sydney, from whence the convict will be taken on to New Caledonia by a French official. With regard to Mr. Jellicoe's notice of appeal to the Privy Council against the ruling of the Court 011 the application for a rule nu*i for a writ of habeas corpus in the case of Gasparini, His Honor said he possessed no power to give leave to appeal in criminal cases, nor had he any jurisdiction to state case for the Privy Council.
