Mr. Lush appeared for the applicant, and Mr. Stewart for the objector. Tho objector's evidence went to prove that ab the time of his pegging tho Kauri Holding, McDonald's pegs occupied a certain position on his (Reid s) eastern boundary, but two or three dnys after McDonald's pegs were shifted westward into tho Kauri Holding, and taking in a portion of hin claim. On McDonald's side the evidence was to the effect that a party of men were engaged to peg out certain ground, but not being sufficiently grounded in the matter of pegging they did not carry out the instructions given them, and did not place the pegs where originally intended. Judgment was deferred till to-morrow.
