MEETING OP CREDITORS.

Nobrib and Kemplay.—The first meeting of the creditors in the estate of Norrie and Kemplay, woollen manufacturer! and storekeepers at Auckland and Clevedon, was held yesterday at the Official Assignee's office. The creditors present were : Messrs. Tewsley (Sargood, Ewen, and Co.), Renshaw, Murray, Carter, Partridge, Heather, Abbott, Hooton, Lamb, Piokard, and Hooker. Alexander M. Kemplay was examined on oath, and stated that they had filed on September 19. He kept the firm's books, and struck a balance in June last, when they were £36 to the good, By Mr. Abbott: "It is true that I told yon on the 19th ir.at. that a bill for £16 given to Mr. Meyer for a horse would be met, and that we were all right. On the morning of the 19th I had no idea we should have to file." By Mr. Heather: "We returned goods to Mr. Murray because we had not capital to make the payments as arranged. We took over the Wairoa business from my brothers, with the consent of some of their creditors. I have given your bookkeeper to understand, oo two occasions, that as soon as Mr. Norrie returned we should make a payment on account." By Mr. Abbott: "I gave my brother a promissory note for money, which he htd paid, which we (Norrie and Kemplay) should hava paid. I believe it is in your possession." In reply to questions by Mr. J. Lamb, Mr. Norrie stated that they had filed on the 19 th of September, that on the 31st of August he had ordered some goods from Mr. Lamb. He told him that he was a son of the Rev. D. Norrie, of Papakura, and that he had a store at Wairoa, and was doing a good business ; that he had been given to understand by Mr. Lamb that payments were to be made monthly, and he accepted the terms. He had given another order on September 10. He gave this second order with a fall knowledge that Mr. Murray had got a judgment summons against the firm. In reply to Messrs. Partridge, Hooker, and Heather, Mr. Kemplay stated that he had ordered goods from Mr. Partridge on the 10th inst., promising to send a cheque for the amount of duty the following day, and that he had said that Kemplay Brothers were doing well two months ago; he was then acting as their authorised agent. The following motion was then proposed by Mr. S. Abbott, and seconded by Mr. Lamb : —"That this meeting, having carefully investigated the circumstances of the bankrupts, are of opinion that they should be dealt with under the penal clauses of the Act, and desire the Official Assignee to take the necessary steps in order to carry out the same." On being put the resolution was carried without dissent. Mr. Heather moved and Mr. Tewsley seconded, "That the Official Assigr«e be requested to call tenders forthwith for the disposal of all the stock, book debts, and fixtures, at Wairoa South, and aiso the bock debts belonging to the original estate of the bankrupts." Carried. Robkkt Heal. — A few creditors only were present at this meeting, and it was decided to adjourn it till half past two this afternoon.
