L. Laishley appeared for Captain McCol!. After hearing the evidence, the Bench letired for a few minutes, and upon their return they gave judgment that they considered that the master took all possible precautions, but thought he was more to the eastward than he actually was, and also that the light he law was a vessel at i anchor misled him. Considering the state of the ] weather they did not feel justifl-id in dealing with his certificate, which was returned. No order was made as to costs. THE RIMUIAKA. THE MARAROA,

The Union Company'* It.M. steamship Mararoa, with the English and American mails, came into harbour early on Sunday, May 9, from San Francisco, via Honolulu and Tutuila. Upon the present occasion the Mararoa has not done as good work as was expected of her, and this was owing to the fact that in her machinery department another accident occurred, which delayed the-vessel for twenty-two hours at sea. Sho is very fairly patronised by passengers, and also brings a largo general cargo. Good order and neatness—a characteristic of all the vessels of the well-known red fuunel prevails on board, and the passengers speak most highly of the courteous treatment received at the hands of Captain Edie and his officers. No sooner was the steamship berthed at the Queen-street Wharf than the work of landing the mails, passengers, and their luggage, and tho cargo for this port was commenced, and vigorously carried on, whilst at the same time the Mararoa received a necessary supply of coal from the coal hulk Neptune. At about 4.30 p.m. she resumed her passage to Sydney,

ARRIVAL OF THE TAINUI,

Messrs. Shaw, Savill, and Albion Co.'s steamship Tainui came into port on Sunday afternoon, May 9, and as the outer berth at the Queenstreet Wharf was then occupied by the R.M.s.s. Mararoa, she was forced to drop anchor in the stream, doing so a short distance below the Railway Wharf, and there she remained until an early hour next morning when she was berthed at the Q-.een-street Wharf. As soon as tho Tainui was inside Rangitoto Reef she was met by the tugboat Awhina, which had on board the representatives of the ship's agents. Captain Babot, Customs efficers, and the Health Officer, and they were all speedily placed on board the larger vessel. Dr. Lewis, finding everyone in good health, the Tainui was given a clean bill of health. The Tainui sailed again on the 11th, for the Southern ports.

The whaling barques Swallow (Captain Mclunie) and Horatio (Captain Morse) both left the Bay of Islands together on Friday on a whaling cruise. During last quarter 57 vessels, aggregating 43,673 tons, aud with crews of 1816 men, entered Auckland; and 25 vessels, with an aggregate tonnage of 19,765 tons, and crews of 583 men, entered Wellington; 23 vessels, aggregating 17,639 tons, with crews of 483 men, entered Lyttelton; aud 25 vessels, with an aggregate tonnage of 23,410 tons, and crews of 743 men, entered Dunedin, On Thursday the schooner Gem went ashore on a reef running out into the Motulapu passage from the quarantine island of Motuihi. By the return of the a.s. Argyle from the Great Barrier, we learn that the schooner Gem had sunk, and all that was visible of her was a few feet of her bows and her masts. At the time i of her going ashore she was loaded with shingle ballast, audit has been ascertained that she.has suffered considerable injury below low-water mark. Efforts were made to float the vessel into shallow wator from on the reef, but without success. The Gem, a vessel of 29 tons, was built at Matakana in 1874. By telegraph from New Plymouth on Friday last, we learn that the brig Star of the Mersey, bound from the Kaipara for Dunedin, was towed into New Plymouth, being in a leaking state. The crew have been taken on shore at Tarauaki from the vessel. Captain Christian reports that the vessel was from Kaipara to Dunedin. She sprang a loak on Thursday afternoon in her bow, and being unable to keep the water down with the pumps, it was decided to run for New Plymouth for shelter. She had eight men board, and, although pumping all night, the water so increased that the vessel became waterlogged and unmangeable. The captain then hoisted a fi ig of distress, whioh was sen from the shore, and the harbourmaster in the tugboat went out to their aid. The captain and men were thoroughly exhausted, and say that, but for the New Plymouth harbour they would have been lost. On arrival two anchors were put out, but the vessel is drifting towards the shore owing to the heavy sea on. They abandoned the vessel. She has a cargo of timber for the Dunedin Wood Company. The captain is part owner, but declined to say what insurance is on the vessel. The Star of the Mersey is a wooden brig of 255 tons register, built at Hylton, Durham, in 1563, and her registered owner is Mr. C. L. Hodge, of Dunedin.

SUMMARY.

During the past month shipping business has been somewhat quiet, the arrivals and departures, though numerous, being confined chiefly to the intercolonial and interprovincial traders. A fair business has been done with the South Sea Islands, the departures for them being the Sandfly, Janet Nicoll, Sybil, Circe, and others. The Janet Nicoll took, in addition to a large general cargo, a number of passengers, and it is avident that the route travelled over by this smart steamer is rapidly becoming popular, besides proving most successful from a business point of view. Thore was only one arrival from England—namely, the s.s. Tiinui, on the 9th instant; but thero are several vossels now due, and to-day tho s.s. Kaikoura should arrive, she boiDg now on our coast. Tho departures Include tho s.s. Rimutaka, which left here for London direct on the 6th instant. She took hence a large cargo, and a moat lengthy passenger list. The Tainui and Ruapehu are both to leave Lyttelton, the first on tho 29ch of May, and N.Z.S. C6.J* vessel on the 3rd of June. They are also being liberally patronised by passengers. The barque Waituea and brigantine Gazelle are both loading here for LondoD, and they are to obtain quick dispatch. They will be followed by tho barque Lutterworth. At the Kaipara the ship Halcione is loading timber for London. The barque Thomas A. Goddard is to lo*d kauri gum for New York, and will be followed by the brigantine Nora* In tho shipbuilding trade matters are exceedingly quiet, the trade being confined to repairing only. The Aucklandowned steamship Triumph has again been put into commission, arriving at Lyttleton from Sydney on Friday night last. There she is to load horses for the Indian market.
