On the resumption of the Waotu ease, Dr. Buller intimated that instead of registering a survey lien to protect the Patetero Company's payments, he would put in evidence in writing of a settlement between Arekatera and the authorised survey, and then, on Arekatera \s behalf, would object under section 42 of the Native Lands Act, 18S0, to the issue of any certificates to other claimants till their proportionate part of the survey charges had been satisfied. He said he had determined on this course because of the unsatisfactory state of the law at present in regard to survey liens. He argued that his present line of action placed the charges bcyoud the review of the Court, the language of the section of the Act cited above being imperative. Hereupon a sharp argument ensued between the counsel engaged in the case. i The Court, after hearing the evidence oj : Arekatera, sustained Dr. B-ullers conten- \ tion, and agreed to make the order as applied ! for. l Dr. Buller than reported to the Court the ' proceedings at the native meeting yesterday, i which had led to no result, and asked the Judge to proceed at once to apportion the i estate in terms of the Act. 5 Mr. Sheehan asked for ai.otiicr day's ad- '» journment iu order that a further effort 1 might be made to effect an amicable arrange- '■' ment. i l . Judge Williams, in agreeing to the ndi; journment, said he regretted the delay, but 4 was of opinion that a voluntary arrange- ~ ment, if found possible, might be more _ satisfactory to the natives than an arbitary 4 division by the Court.
