He (Mr. Cowlishaw) was then directed to consider whether criminal proceedings might be taken against the defendant for larceny or embczz'einent Upon technical grounds he did uot see how criminal proceedings conld be, as it "was conside-ed that the receipt of moneys by the defendar \ was not a part of hi 3 duties as a public sirvaut. He wag, therefore, driven to lay the information against defendant under the Stamp Fee Act, to recoup the revenue of the deficiency. Tii ere was reason to believe that in all cases the defendant received the fees, but in consequence of the absence of some of the parties, evidence in all cases with which tho purpose '-f tho Stamp Act, ho had neglected to stamp the documents.
