WAIUKU R.M. COURT.— Friday.
[Before T. Jackson, Esq., Ii.JL. and_W. J. Uarri«, Esq., J.P.I P. Colthard v. J. B. Brown : Claim £25. Mr. Laishley appeared for plantiU", and Mr. Hesketh for defendant. It appears that defendant ordered timber from plaintiff, and some time after sent a letter withdrawing the order ; mostof tlie timber had been cat during the time, aud the plaintiff, sent the timber to defendant,..which he (defendant) refused to take. ,The action.was for £25, £20 loss on timber, and loss of time. Mr. Hesketh raised an objection,' that the order was not stampcd7~~and-stated that all orderg for over £10 should be. Tho Bench said that the objection raised would prove fatal to the case, and gave judgment for defendant with costs.
