Mr. Gilliei moved for a decree in favor of plaintiff, defendant having failed to amend his plea in accordance with leave granted to him by the Court at a foiraer sitting. The Court granted the application, which is tantamount to judgment for plaintiff. THE QUEEN V. J. B. IIACPAKLANE AND J. T. MACKBL•VIB —CUSTOM HOUSE PBOBECUTION. "Mr. Gillies applied for leave to have this action dismissed, for,want, of prosecution. Order mnde that unless plaintiff, within one monih, undertake to try the cause at the March sitting of the Supremo Court, the action should be dismissed. GIBDWOOD V. HURON AND OTHEBS. Mr Gillies, on hc-hulf of defendant, moved to dismiss the action as against one of the defendants, K. J. Matthews, for want of prosecution. Order made that unless plaintiff proceed with his action Tithin one month it be dismissed. Mr. Whitaker appeared for plaintiff. in be st. Matthew's church building trust tund. Mr. Whitaker appeared on behalf of petitioners, pray in a: for the appointment of a new trustee in place of O. Sanderson, resigned. There was no opposition, and the order was granted accordingly. The Court then rose.
