JUSTICE.

To the Editor of the Hbrald. Sl B) —A. somewhat extraordinary decision, as it appears to the uninitiated, was given in a case in our Beaidont Magistrate's Court, Kaglan, List Monday. Some time ago a summons was taion out by Sir. Joseph Graham against Mr. Ch3rlea He Thierry for house rent. Defendant was at the Timmes, and the summons wae returned. Another one wus taken out nnd duly served. On the day appoi"tel for the hearing, plaintiff wue told that the case was adjourned, a document having arrived from George Urahnai, Esq.,J.P., to tho elToct that the defendant was particularly engaged. Again the case camo on (or hearing, but still no appearance of defendant. Plaintiff was then sworn, and stated that the defendant had lausi'd his (plaintiff's) house for 12 months certain, at the expiration of which period either party wes at liberty to conclude the .agreement by giving one month's notice. Defendnnt loft Haglan without any mch notice; in fact, a considerable period elapsed over the month beforo plaintiff, by much enquiry, got the key of the back door, that of the front being Htill either lost or in defendant's possession. Judgment wafl givi-n for defendant, on the plea that plaintiff knew th:it defendant had left Kaplan, and he (plaintiff) should therefore have applied for an or or from the Court to take possession of the house. Kaglan, 16th January IS6B. Irtrx. [ The latter pirt of the lotter of " Lux " wo hare withhold. His proper course is to lay the matter before ihe Attorney-Cieneral.—Ki>. N.Z.IT.]
