POLICE OFFICE, August, 11th.

Yesterday, Mr. Fitzherbert, one of our merchants, was charged by M. Murphy, Esq., the Sheriff, with assaulting one of his officers in the execution of his duty.; ' It appeared in evidence, that the chief constable arrested Captain Munn, of the Lady Leigh, on- the previous day* for the-sum of £157. The constable stated that the Captain requested to be allowed to consult with the owner of the Lady Leigh, Mr. Fitzherbert, to. which he consented. While the Captain went into. Mr. Fitzherbert’s store the constable remained within the threshhold. Mr. Fitzherbert ordered one of his men to remove him from the premises, to which he objected, stating that he was an officer, and that he considered Captain Munn as his prisoner. On this Mr. Fitzherbert and one of liis servants forcibly removed the constable from the store, and locked the door. The constable, finding he was prevented from retaking his prisoner, sent word to the Sheriff, who, accompanied by G. White; Esq., J. P„ soon after made'his appearance, when Captain Munn was taken'into custody. Mr. Fitzherbert, in his defence, denied that the officer stated to him who he was, and also that he did not himself turn the constable out of his store. Three witnesses corroborated the statements of Mr. Fitzherbert. After a lengthened examination, (which, from the lateness of the hour, we are not able to* give the particulars in detail,) the caSe was.'dismissed. . We have since heat# that Captain Munn has been liberated.
