POLICE COURT.—Saturday.

(Before Dr. Home, J,P., and J. O'Neill, Esq., J.P.) Drunkards.—John Rothray and George Turtle, on bail, were dealt with in the usual manner.

Assault. —Robert Williams appeared, charged with assaulting his wife, Mary Williams, The prosecutrix being through illness, unable to appear, the case was remanded until Su:u day next. Disobedience of Okdbrs.—William Wilson was brought up on remand charged with the above offence on board the ship ' Lindsays.' Prisoner pleaded sorrow lor his fault and the captain consenting to tike him on board, the case was dismissed. Housebreaking. Juh 1 Underwood and John Donogbue were brought up on remand, charged with breaking into the house of one William Foster, at Blake's Bush, and also with attempting to steal sundry articles therefrom. David Davis, a laborer, deposed that he knew the prisoners and had seen them about five o'clock on Monday evening last, when they broke into the house. Witness had been lying in his bed at the time, and heard footsteps come towards the house, and some one singing out to the dog. The door was then forced open by the prisoners, who entered. The prisoner Donoghue proceeded to Foster's bedroom and caught hold of the padlock on the door, which was locked, and twisted it with his hand, when the witness jumped out of bed and asked him what he was doing there. Prisoner made no reply, but still retained hold of the lock. Prisoner said he wanted some tobacco and a box of matches. There was a double-barrelled gun over the chimney, which witness took down, and ordered the prisoners, who were both '.ogethcr at the time, to sit down. Underwood sat down and his comrade tried to escape, seeing which, witness caught hold of him by the collar of his coat. Had eventually made prisoners of both of them, and marched them down to the public-house at Wairoa Bridge, where he retained them until the police came. The prisoners cross-examined the witness for some time the only effect of which was to assist very considerably towards criminating themselves. William Foster deposed that he had met the last witness bringing down the prisoners to the public house, and that he had assisted him to take them there. The Bench were of opinion that the charge of housebreaking with felonious intent had not been proved, and therefore they would have to be d scharged on that count, as there were other circumstances against them however, suspicious of their being deserters they would order them to be handed over to the Military authorities. Larceny.—Samuel L Smith and William McLeod, appeared on remand charged with stealing a watch and chain from the person of one Thomas Aldridge. Case remanded until Monday next at the request of the Commissioner as the property had not yet been recovered.
