PROCLA MATIO N.

By His Excellency George Grey, Esq., Lieut.-Governor and Commander-in Chief in and over Her Majesty's Colony of New Zealand and its dependencies, and Vice Admiral of the same, &«., &c. WHEREAS by an Ordinance enacted by the Lieutenant Governor of New Zealand, with the advioe and consent of the Legislative Council thereof, Session 6, No. 1, intituled— " An Ordinance to empower the Governor of New Zealand, to legulate the Importation and sale of Arms, Gunpowder, and other Warlike Stoics :" power is given to the Governor, to prdhtbit or to make pi ovision for regululingand restricting throughout the Colony, or within any district thereof, the impoitation and sale of arms, gunpowder, and other wailikeslores. And whereas it is expedient that restrictions should immediately be placed on the Importation and sale of Arms, gunpowder, and other warlike stores. Now, therefore, l the Lieutenant Governor, in pursuance of the authority in me , vested, by the said recited ordinance, — do hereby Prohibit throughout the colony of New Zealand, the importation of arms, gunpowder and other warlike stores, except in manner, and subject to th« conditions hereinafter mentioned, — (that is to say; — From and after the date hereof, no Arms, Gunpowder, or other warlike stores, shall be itnpoited, or landed or soM, or olheiwise disposed of in the colony of New Zealand, without a License first obtained for that purpose under the hand of the Lieutenant Governor, Supeiintendent of the Southern Division, or of the Colonial Secretary j and at the place, in the manner, and according to the times and conditions specified in such license. Provided always that nothing herein contained shall prevent any peison coming into the colony, from landing such aims and ammunition as he may eairy for his personal defence, or for purposes of sporting, or shall apply to the importation and landing of supplies lor the use of hei Majesty 's land or sea forces. And I do hereby also proclaim and declare, that for more effectually detecting and preventing the unlawful impoitation, sale, and ot..er disposition of arm«, gunpowder, and other war-

like stores, 1 will cause to be awarded to any person or persons, who shall have been active in procuring the conviction of any offendor, under the provisions of the said recited ordinance, one half of the penalty which may be received by virtue thereof.

Penalties and Forfeitures imposed by the <l Arms Impoitation Ordinance," Session t>> No. 1. 3 Every person who shall import, or bring into the colony, any arms, gunpowder, or other warlike stores, (whether the owner thereof, or not,) and who shall wilfully and knowingly and contrary to the provisions of any such proclamation, as aforesaid, land, or dispose of, or cause or permit to be landed, or otherwise disposed of, such arms, gunpowder, or other warlike stores or any part thereof, shall for every such offence forfeit and pay any sum not exceeding £500, to be recovered in a summary way. And any arms, gunpowder, or other warlike stores, which shall have been imported and lauded, or otherwise disposed of, contrary to the provisions of any such proclamation, as aforesaid, shall be forfeited to her Majesty, and may be seized by any Justice of the Peace, or Peace Officer, or by any Officeis of Her Majesty's Customs, or by any person duly authoiised and appointed in writing by his Excellency the Governor. 4. The master or person commanding the ship or vessel in which such arms, gunpowder, or other warlike stores, shall have been imported, if he shall wilfully and knowingly, and contrary to the provisions of any such proclamation, as aforesaid, land, or dispose of, or cause or permit to be landed, or otherwise disposed of, such, arms, gunpowder, or other warlike stores, or any part thereof,shall also, for every such offence forfeit and pay any sum not exceeding £500, to be recovered in a summary way. And upon the conviction of any such person or master, snch ship or vessel, with all her furniture and apparel, shall be forfeited to her Majesty, and may be seized by any Justice of the Peace, or Peace Officer,or by any officer of her Majesty's Customs, or by any person duly authorised and appointed by his Excellency the Governor. 5. Every person who shall wilfully and knowingly, und contiary to the provisions of any sucli proclamation as aforesaid, sell, or dispose of any arms, gunpowder, or other warlike stores, shall for every such offence, foifeitand pay any sura not exceeding £500, to be recovered in a summary way; and all arms, gunpowder, and other warlike stores, so unlawfully sold or disposed of, shall be foifeited to her Majesty, and may be seized in manner hereinbefore provided. Given under my hand, and issued under the Public Seal of the Colony, at Government House, Auckland, this twenty-first day of January, in the Year of our Lord One thousand eight hundred and fortysix.
