MAGISTRATS'S DECISION. DEFENDANT POUND GUILTY. (P«r Press Association.) WELLINGTON, September 4. Giving judgment in the ctse against Abraham Levy, Mr L. G. Reid, S.M., quoted the regulations as already set out. He had already ruled out the point that they were ultra vires. The defence raised'was practically one of ignorance. Against that they had the fact that specifications were produced to the tenderer, and clause t laid down the use 'of linen thread. Defendant himself signed the contract. Later lie was written to by the Department regarding the matter, and the evidence went to show that defendant received the letter and produced it to one of the witnesses.

His Worship found on the evidence that defendant had been guilty. The only other question was as to penalty. It seemed to him impossible to say that a person could accept the- conditions of the tender, sign the contract, and have his attention drawn to the alleged breach, and yet be ignorant. The plea of ignorance could not be sustained. The maximum pentlty provided was £IOO. He took■ into_consideration thi .fact that it had been given in evidence that defendant's contract had been discontinued, and that a large number of garments hail been left on. his hands.
