Other evidence as to ' the circumstances of the alleged assault was B'™\ J ' r Baumc, lor the" defence, sub. nutted that although an assault may have been committed, the .action'of Mrs Semite had been larircly responsible lot it, and that it was therefore no case to go to the Supreme Court. The Bench however, thought otherwise, and considered, under the circumstances and in justice to ■ society at large, the case should be tried before a jury, The defence was therefore 'reserved. Bail was allowed, in two sureties of £SO each and accused himself in ;£loo'.
