MUNICIPAL COUNCIL.

The usual fortnightly meeting took place in the Council Chambers on Thursday evening. Present — His Worship the Mayor and Councillors Sinclair, Mainland, Falconer, Headland, Seott, Morton, and Grave. MINUTES. The minutes of last meeting were read and confirmed. The outward correspondence was read and approTed.

GAS PLANT. The Clerk mentioned that some of the gai plant brought by the brigantine Yarra wag damaged, and it was resolred that the Corporation solicitor be instructed to take steps tovrnrds recovering from the captain of that tcsscI the amount of the damage sustained.

CORBESPONDENCE. The inward correspondence was as follows : 1. A petition from certain residents, asking that tbe pump in High Ward be repaired. On tbe motion of Cr. Scott, seconded by Cr. Headland, it was resolved that tbe pump be repaired at once. 2. A letter from Mr. Peter M'Nab, asking permission to make a crossing or rigbt-of-way to his premises in Wansbeek-sfcreet. On the motion of d. Scott, seconded by Cr. Headland, it was resolved tb«t permission be given to make a temporary crossing — the work to bo done under the supervision of the Town Surveyor. 3. A letter from Mr. J. T. Richards, applying for permission to transfer tbe lease of Municipal Section 6, Block 38, to Mr. Walter Newton. It was resolved that permission be granted, providing all arrears of rent be paid. 4. From Mr. John Church, asking for permission to make a crossing to Mr. James Paterson's premises in Wansbeck-street. On the motion of Cr. Headland, seconded by Cr. Scott, it was resolved that permission be groDted — work to be done under the supervision of tbe Town Surveyor. 5. From Mr. John M'Kay, applying for permission to make a drain to carry off surface wnter from Section 1, Block 92. On the motion of Cr. Headland, seconded by Cr. Scott, permission was granted — work to be executed under the supervision of the Town Surveyor. 6. An application from Messrs Paterson and Weed on for permission to lease tbe Garden Reserve in Tyne street for one month or longer. Application declined, as tbe Council are using tbe Reserve. 7. Consisted of applications from the following persons for permission to lease the Municipal sections given : — Section 12, block 33, H. Goodeon ; section 21, block 79, Ritchie Young j section 14, block 89, John Cormack; sections 7 and 17, block 70, la, M'Grath. 8. An application from Meisrs Miller and Smillio to erect a wooden hut in their monumental yard, Thames street (a portion of section 5, block 6). After some discussion it was resolved that permission be not granted. 9. A letter from the District Engineer, Mr J. H. Lowe, aiking for the permanent level of Lune street, so that the railway crossing in that street may be made. Tbe letter wa« referred to the Public Works Committee, and tbe Surveyor' to report upon. 10. From the same gentlemtn, granting permission to lay the mains from the gas* woiko to Weir street (under the railway line) on condition that 24 hours' notice be given to the Inspector of Permanent Way, Oamaru, before the work is begun, and tbe work to be carried out under his superintendence. 11. The following letter from Mr Alex. Willis, Provincial TJnder-Secretary, under date, December 10:— "To the Town Clerk, Oamara. Sir — I have been directed to acknowledge the receipt of your letter of the 30th November, and to convey to the Oamaru Town Council the desired permission to make a cut for tbe Oamaru Creek, through the Beser»e for Public Gardem, as per plan, which is herewith returned." 12. From Mr J. H. Lowe, intimating that tbe proprietors of Sec». 4, 23, and 24, Block IV., wish to subititute tbe present road for tbe one shown on the tracing (enclosed) for access to reserve 59. It was resolved — That the Public Worka Committee, and Surveyor, intpect the proposed road, and report thereon, and that Mr Lowe be acquainted with the reault of that report.

TBNDEBB 70S WOSES. The following tender* -were opened for Contract 88— Work in Teea ttreet, »nd metalling footpathi in Reed street :—

On the motion of Cr. Headland, seconded by Cr. Grave, it was resolyed that the tender of Mr Thos. Flaherty be accepted, and should lie not accept, then Mr Stephen Bradburj's tender to be nccepted. — Carried.

On tho motion of Cr. Headland, seconded bj Cr. Mainland, it was resolved tbat the trader of Mr Flaherty be accepted, and if he do not accept, then Mr Stephen Bradbury's tender he accepted.

It was resolved, on the motion of Cr. Headland, that the tender of John Johnston and Co. be accepted; and should they not take up the tender, then Mr B. Battersby's tender to be accepted ; seconded bj Cr. falconer. Cr. Sinclair moved, as an amendment, that none of the tenders be accepted. The amendment was not seconded, and the motion, on being put, *as carried.

PUBIIC TVOEKS BBPORT. The following report waa read : — 1. Your Committee having: examined, as requested, that portion of Humber street, from Hibble street to the town boundary, recommend that it be formed on the west side, 30 feet wide ftom the building line. 2. Tour Committee desire to call the Council's attention to the gorse hedges in this street, which they strongly recommend should be removed, they being both dangerous on account of fire, and likewise a nuisance, owing to the way they are allowed to encroach over the footpath. 3. Jit drain from Mr Gibbs's property in Hnmber street, your Committee do not think that the present works will interfere with the drain. Should they do so, the extension of the drain could bo done at a very small cost. 4. Tour Committee waited upon Mr Lowe, the District Engineer re railway crossing in Lubc street, (o which he promised his attention. 5. Your Committee beg to draw the SurTeyor's attention to the quality of the metal now being broken in "Waasbecfc ttreefc. 6. Your Committee instructed Mr Connell to survey the reserve facing Thames street, ■which has been done and pegged off as per plan ; have also instructed the Town Clerk to "Write to (he Government re diverting the Greek j find the removal of the wuter tanks ■will not be necessary, being situated in the right-of-wny : have instructed the Surveyor to make the road good to the tanks. 1. Your Committee wish to call the Council's attention to the Recreation Eeserves, some buildings having been erected thereon ; one reserve has not yet been fenced in, and nearly in all the reserves the road-line in the Town Belt has been enclosed as part of the reserves ; your Committee think it desirable that the terms of the lease should be adhered to. The first paragraph, on the motion of Cr. Headland, seconded by Cr. Grave, was adopted, and the Surveyor instructed to prepare plans for the work. The 2nd paragraph was adopted, on the motion of Cr. Scott, seconded by Cr. Morton — The Inspector of Nuisances to be instructed to take the necessary action. Paragraphs 3, 4, and 5, were adopted •without any comment. Paranruph 6 was also adopted, and, on the motion of Cr. Grave, seconded by Cr. Scott, it was resolved — That the Town Surveyor be requested to make a copy on a larger scale, and that 100 copies of the plan be printed. After some discussion, it was resolved — That the upset price of the corner sections on the Town Hall and Gasworks Site Eeserve be 35s per foot, per annum, and for the intervening sections 30s per foot ; that a draft lease for 21 years be prepared by the Corporation Solicitor, and submitted at the next ordinary meeting of Council, the terms to be similar to those in the Municipal leases ; and that no other buildings than stone, brick, or concrete be erected on the property. "With reference to paragraph 7, it "was resolved — That the Iuspector of Nuisances be requested to report thereon at the next meeting of Council. gas wobks committee's beport. " The Tenders having been opened for the construction of a concrete tank (cement excepted), it was resolved that Mr E. Rowland's tender of L133 be accepted." The report ou the motion of Cr. Falconer, seconded by Cr. Scott, was adopted.

ACCOOIfTS. Sereral accounts were passed for pajment.

SALT TVATEU BATUS. A deputation, consisting of Messrs Alosley, A. Headlund, and James Familton, were then introduced to the Council, and presented the following petition : — " To the Worshipful the Major and Coun- " cillors of Oamaru. " At a public meeting held on Thursday, the 16th instant at the Royal Hotel, it having been unanimously reaolved that it is desirable that salt water baths should be erected in Oamaru, we the undersigned respectfully request that you will take the matter into your farorable consideration, with, a Tiew to the construction of such baths." [Here follow 148 signatures.] In reply to a question asked by Cr. Headland, Mr. Mosley snid that to construct saltwater baths, according to Mr. Glass's plan, it would cost about £800. In reply to the Mayor as to the site proposed for erecting the baths, Mr. Familton said he thought it would be better to erect them north of the lagoon. He was of opinion that if the Council took the matter into faTorable consideration, baths could be erected at u much less cost than £800. Cr. Falconer s»id he thought it would be Better if the deputation could lay any information whioh they possessed, as to site, plans, probable cost, &c, before the Council. His Worship the Mayor iuformed the deputation that the Council would take the matter into consideration, and communicate with them at an early date. After the deputation had withdrawn, the Major suggested that a Committee should be Appointed by the Council to confer with a Committee elected by the citizens, to glean any information they could on the subject. On the motion of Cr. Headland, it wa3 reiolred that a Committee, consisting of the M»jor *nd Crs. Falconer, Sinclair, and the moTer, confer with a deputation, elected at the late meeting of citizens, re the erection of salt water baths, and report at next meeting of Council. Cri. Grave and Mainland were of opinion that it was a matter for private enterprise, and not for the Council to undertake. The Clerk was requested to forward a copy of the aboye resolution to the gentlemen forming the deputation from the citizens' meeting.

GENERIC. Tlie Clerk was requested to insure the workshop and office attached to the Gasworks in the New Zealand Iniuranco Company.

On the motion of Cr. falconer, seconded b? Cr. Grave, it was resolved that tenders (to bo sent in by next meeting of Council) be called for the formation of Eden street. Or. Scott's motion, to take into consideration the advisability of leasing the Town Hall site, was referred to the Reserves Committee to report upon. Cr. Grave rose to mote — " That the resolution passed at the meeting of Council held on the 29th November, committing the Council to widening the Bridge on the west side, be rescinded, and that the question be determined on its merits, without reference to the former resolution." After considerable discussion, during which Crs. Mainland and Scott left the meeting, the Mayor decided that the motion could not be put, as a resolution had previously been carried by the Council to the effect that all further discussion on the question should be deferred until the Harbor Board has expressed its decision on the question put to them. The rough minutes having been read, the Council (at 11.15) adjourned.
