One of tub Dkfkncb Fobcb Shot by the Hatx ILvrs.— The Wellington Independent, of the 27th Ultimo, says: — "We learn by private advices from Paten that a private in the Wanganui Yeomanry Cuvnlry, named Hugerty, was shot and tomahawked, on Monday last, while on his way from Patea to one of the outposts of Major Macdonnell's head quarters. Hagerty and two men of the Defence Force had been sent with a wagon when the Maoris attacked them. Poor Hagerty's horse -was shot first, then he received some bullets, and, falling, was frightfully tomakawked by the rebels. Important Decision to Owners op Steamebs.— In the District Court in Wellington, a few days ago, Mrs. Brosen brought an action against the New Zealand Steam Navigation Company, to recover the value of two boxes containing luggage. The lady had taken her passage, at Auckland, for Wellington, in the Ladybird, a steamer belonging to the Company, and bad tent two boxes, containing her lugpigo, on board, but through some circumstance she did not proceed to Wellington by the steamer in question, but came on thence in one that next followecK It was given in evidence that the boxes in question were landed on the wharf with the luggnge of other passengers, and was seen there by the wharfingers, but subsequently disappeared, the lady not being present to look after them. In giving judgment, his Honour the Judge said: — "The deliven of goods is as much the duty of the carrier as tho carriage thereof. I am of opinion that the cour so pursued by the defendants in this instance with respect to this alleged delivery, amounts to a wilful mixfeucance, and to an entire renunciation of their diameter as carriers, and that they are consequently liable to the plaintiff, notwithsanding the terms of the original contract."
