NELSON BOARD OF WORKS. NOTICE IS IIEEEBY GIVEN, that the following amended BY-LAW has been agreed to by the BOARD OF WOEKS, and has been submitted to his Honour the SurERiyTEXDEXT and his Executive Council for confirmation. Br-Lvw^ No. 5. Where.49 it is expedient to make further provision for the abatement of the nuisance and danger caused by the present growth of Fckze or Gorse, &c, throughout the city of Nelson ; Be it Obdeeed and Directed by the Board of Works for the said city, -svith the sanction of his Honour the Superintendent and his Executive Council, as follows, viz: — 1. The occupier, or in case there shall be no occupier, then the owner of any land upon which a gorse or other hedge shall be growing, adjoining any public street or road, shall, so soon as the portion of the said street or road adjoining his said land shall bo clear, thenceforward keep the same at all times clear of gorse or other obstructions which it may reasonably be supposed have proceeded from the said hedge ; and in case such occupier or owner, as the case may be, shall refuse or neglect to cleai* such road or street, after receiving seven days' notice to do so from the Board of Works, he shall be liable to a penalty of not exceeding 405., and to a further penalty of not exceeding 203. per week, for every week he neglects or refuses to comply with the order contained in the said notice. 2. Whenever gorse or any other inflammable plants shall be growing upon any land, in such thickness, height or quantity, as to be a nuisance to the public, or dangerous to any near or adjoining private property, the Board of Works may give the occupier or owner of such land seven days' notice to clear away or trim such gorse or other plants in such manner as may be directed by the said Board : and in case the said occupier or owner shall fail to comply with the said notice, he shall be liable to a penalty of not exceeding 405., and to a further penalty of not exceeding 20s. per week, for every week such gorse remains uncleared or untrimmed. 3. Whenever any gorse is growing upon unoccupied land, and the owner of the land is absent from the province, it shall be lawful for the Board of Works to cause such gorse to be trimmed or cleared as they may direct, and the expense of so doing may be recovered at any future time, within six years, from the owner or occupier of such land, in a Bummary manner, before any Resident Magistrate, or two Justices of the Peace.
