FOOT-PATH ORDINANCE.
[Pasted the 14th October, 1847.] An Ordinance to provide for the Protection of Foot-paths in the Colony of New Zealand. Be it enacted by the Lieutenant-Governor of New Zealand, with the advice and consent of the Legislative Council thereof, as follows :— 1. When and so soon as any foot-path already laid out, or which shall hereafter be laid out, in any street, road, or public place within the colony, shall be well and sufficiently made and completed for the use and accommodation of foot-passengers, it shall be lawful for his Excellency the Governor to declare the same by a notice to be published in the Govern' ment Gazette, to be a public foot-patb, and from and after such notification, the same shall be deemed and taken to be, a public foot-path within the meaning of this ordinance. 2. Every such notice shall set forth, as nearly as may be, the situation and extent of the foot, path to be named therein. 3. If any person shall wilfully run, draw, or drive, any truck, wheelbarrow, cart, or carriage whatsoever, or shall wilfully ride, lead, or drive any horse, or any horned or neat cattle, on any such public foot-path as aforesaid, every person so offending shall upon conviction forfeit and pay for every such offence any sum not exceeding twenty shillings, to be recovered in a summary way. 4. If any person who shall be found running, drawing, or driving any truck, wheelbarrow, cart, or carriage, or who shall be found riding, leading, or driving any horse, or any horned or neat cattle, upon any such foot-path as aforesaid, shall continue so to do, after being warned to the contrary, by any constable or other person, every person so offending shall upon conviction forfeit and pay for every such offence, the sum of five pounds, to be recovered in a summary way.
